The high court sitting in Kwale, Ndokwa West local government area of the state on Wednesday sacked the deputy speaker of the Delta state House of Assembly, Friday Osanebi, over the falsification of his NECO certificate used for his 2015 house of Assembly election.
Delivery the four hours judgement on thirty four pages by the presiding Judge, Justice V I Ofesi , the court ordered the Independent National Electoral Commission, (INEC) to withdraw certificate of return earlier issued to Mr. Friday Osanebi and issued same to Mr Lawrence Ozegbe as the winner of the 2015 Ndokwa East Constituency Election into the state Assembly.
The Court also directed the Speaker of the state House of Assembly to sworn in Mr. Lawrence Ozegbe as the rightful member of the State House of Assembly.
According to Justice Ofesi, the Case commenced soon after the 2015 PDP primaries where the clamant protested the conduct of the said primaries and order the honourable court to disqualify the first defendant from contesting the 2015 general election into the Delta state House of Assembly as a candidate of Ndokwa East.
The court also declared that the first defendant lied on oath by submitting a NECO certificate on falsehood saying that no rightful evidence has proven that Friday Osanebi actually sat for and wrote his NECO examination at Orogu Grammar School, Orogu.
The counsel to the defendant Ikide Ehighelua, said he will study the judgement first while the counsel for the claimant F.A. Onuzulike described the judgement as a perfect one and a demonstration of justice.
